2. Scope
These Terms and Conditions of Sale, hereinafter the “Terms”, apply to orders for products concluded at a distance between SARL EMEIS / Aura Store and a natural person acting as a consumer.
The applicable Terms are those made available to the customer at the time of ordering.
They supplement the information presented on the product pages, the shipping policy, the returns and refund policy and the privacy policy.
3. Products
Aura Store presents the essential characteristics of the products offered for sale by means of, in particular, photographs, descriptions, prices, sizes, colours and variants.
Despite the care taken in their presentation, colour rendering may vary depending on the screen used.
Photographs cannot guarantee a perfectly identical rendering of the product on every device.
Products are offered while stocks last.
4. Prices
The applicable prices are those displayed in the shop at the time of ordering.
For sales intended for the French market, prices are shown in euros including all taxes where VAT applies.
For other markets, the price, currency, taxation and any applicable charges are those displayed for the selected destination market.
Any delivery charges are shown before the order is finally confirmed.
Aura Store may change its prices for future orders. A price change does not affect an order that has already been confirmed, except for a correction required by law or with the customer’s agreement.
5. Orders
The customer selects the desired products and variants, checks their basket and then enters the information required for delivery and payment.
Before final confirmation, the customer can check the details of the order and correct any errors.
The order is recorded when the payment process has been completed and an order confirmation has been issued by Aura Store, subject to the necessary checks and to product availability.
A summary is sent to the email address provided when ordering.
6. Availability
Stock information is updated as accurately as possible.
If a product is exceptionally unavailable after the order, Aura Store informs the customer and, as appropriate, cancels and refunds the product concerned.
7. Payment
Payment is made using the methods offered at checkout.
Where instalment payment solutions or services provided by a third party are offered, their specific terms are communicated by the provider concerned.
Aura Store may suspend or cancel a transaction in the event of payment refusal, an obvious anomaly, reasonable suspicion of fraud or unauthorised use of a means of payment.
8. Delivery
Carriers, areas served, charges, preparation times and transit times are detailed in our Shipping Policy.
Aura Store delivers the products on the date or within the period communicated to the customer.
Where transport is entrusted to a carrier offered by Aura Store, the risk of loss of or damage to the goods passes to the customer when they, or a third party designated by them, take physical possession of the product.
9. Click & Collect
When the option is offered at checkout, orders can be collected free of charge at:
Aura Store
2 rue Châteaurenault
35000 Rennes
Customers must wait for confirmation that their order is ready before coming to the shop.
10. Right of withdrawal
Subject to the exceptions provided for by law, the consumer has 14 days from receipt of the product to inform Aura Store of their decision to withdraw.
This decision may be communicated by means of:
- an unambiguous statement sent to contact@aura-estore.com;
- the model form set out in our returns policy;
- the electronic withdrawal function offered in the shop.
After notification of withdrawal, the product must be returned under the conditions and within the time limits provided for by the regulations.
Full details are set out in our Returns and Refund Policy.
11. Return costs
The direct costs of returning a product when exercising the right of withdrawal are borne by the consumer.
This rule does not deprive the consumer of the rights they enjoy, in particular where a product is non-conforming, defective or incorrectly shipped.
12. Condition of the returned product
The consumer may handle the product to the extent necessary to establish its nature, characteristics and proper functioning.
The consumer may be held liable where the product has lost value as a result of handling beyond what was necessary for that examination.
13. Exceptions to the right of withdrawal
The exceptions to the right of withdrawal provided for by the French Consumer Code apply where their conditions are met.
These may include certain personalised products or certain sealed goods which, once unsealed, cannot be returned for health protection or hygiene reasons.
A promotion, a price reduction or the listing of an item in the Archives does not, in itself, remove the statutory right of withdrawal.
14. Refunds
Where a right of withdrawal is validly exercised, the sums due are refunded under the conditions and within the time limits provided for by the regulations.
For a sale of goods, Aura Store may withhold the refund until it has received the product back or received proof of its dispatch, whichever occurs first.
The refund uses the same means of payment as that used for the initial transaction, unless the consumer expressly agrees to another means at no additional cost.
15. Statutory guarantees
Statutory Guarantee of Conformity
As a professional seller, Aura Store is liable for lack of conformity covered by the statutory guarantee applicable to goods sold to consumers.
In particular, the consumer has two years from delivery of the goods to request the application of the statutory guarantee of conformity where a covered defect appears.
Where the legal conditions are met, the consumer may request the repair or replacement of the product, free of charge and under the conditions provided for by law.
In the cases provided for by the regulations, the consumer may also obtain a price reduction or terminate the contract.
A repair carried out under the statutory guarantee may extend the guarantee under the conditions provided for by the French Consumer Code.
Warranty Against Hidden Defects
The consumer also benefits from the warranty against hidden defects provided for by Articles 1641 et seq. of the French Civil Code.
Where its conditions are met, this warranty may in particular allow a price reduction or a refund upon return of the product.

17. Personal data

18. Force majeure
Aura Store cannot be held liable where a failure results from an event meeting the criteria of force majeure within the meaning of French law.
19. Applicable law
These Terms are governed by French law, without depriving a consumer residing in another country of the mandatory protective provisions from which they may benefit under the applicable regulations.
In the absence of an amicable resolution, the dispute may be brought before the competent court in accordance with the applicable rules of procedure.
20. Changes to the Terms
Aura Store may amend these Terms for future orders, in particular to reflect regulatory, commercial or technical developments.
The version applicable to an order remains the one made available when it was concluded.
